1. Scope and Provider

These Terms of Use govern your access to and use of bookcall ("Service"), a scheduling and booking platform operated from Germany.

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

2. Description of Service

bookcall provides a web-based platform that allows users to:

  • Create personalized booking pages for scheduling meetings
  • Connect calendar integrations to manage availability
  • Receive and manage booking requests from guests
  • Send automated notifications and reminders

The Service is provided "as is" and "as available" without any guarantees regarding uninterrupted access or error-free operation.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

4. Subscription and Pricing

bookcall offers both free and paid subscription plans. By subscribing to a paid plan, you agree to the following:

Pricing Changes

We reserve the right to modify our pricing at any time. Price changes for existing subscriptions will take effect at the next billing cycle following reasonable notice (typically 30 days). Your continued use of the Service after a price change constitutes acceptance of the new pricing.

Billing

Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your plan). Payment is processed through Polar. You authorize us to charge your payment method for the applicable subscription fees.

Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription will remain active until the end of the current billing period. No refunds are provided for partial billing periods.

Feature Changes

We may add, modify, or remove features from subscription plans at any time. We will endeavor to notify users of significant changes that affect their current plan.

5. User Conduct

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Send spam, unsolicited messages, or engage in abusive behavior
  • Impersonate others or misrepresent your affiliation with any person or entity
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated systems to extract data without permission
  • Upload malicious code or content

We reserve the right to investigate and take appropriate action, including account termination, for violations of these Terms.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by bookcall and are protected by intellectual property laws. You retain ownership of any content you submit through the Service.

By using the Service, you grant us a limited license to use, store, and display your content solely for the purpose of providing the Service.

7. Third-Party Services

The Service integrates with third-party services (calendar providers, video conferencing tools, payment processors). Your use of these integrations is subject to the terms and privacy policies of those third parties. We are not responsible for the availability or functionality of third-party services.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • No Warranty: The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • No Liability for Damages: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from your use of or inability to use the Service.
  • Maximum Liability: Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
  • No Guarantee of Bookings: We do not guarantee that any bookings will be made through your booking pages, nor do we guarantee the attendance or conduct of guests who book meetings.

These limitations apply even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless bookcall and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of third parties.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may:

  • Perform scheduled or emergency maintenance
  • Modify or discontinue features at any time
  • Suspend the Service temporarily for technical or security reasons

We will make reasonable efforts to notify users of planned maintenance that may significantly impact Service availability.

11. Data and Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal data.

You are responsible for ensuring that your use of the Service complies with applicable data protection laws, particularly when collecting and processing personal data of guests who book meetings with you.

12. Termination

Either party may terminate this agreement at any time. You may terminate by deleting your account. We may terminate or suspend your access immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our data retention policies and applicable law.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.

For consumers within the European Union, mandatory consumer protection provisions of your country of residence shall apply where they provide greater protection than German law.

Any disputes arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts of Germany.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
